No clarity on who actually bribed: Mukul Rohatgi on Adani-US SEC Row

The senior advocate former attorney General Mukul Rohatragi said on November 27. Neither Gautam Adani nor his nephew was charged with violating the US Foreign Corrupt Practices Act (FCPA). The indictment was filed by US prosecutors for the bribery case.

By addressing the media Rohatgi said the indictment referred to allegations of Adanis bribing the Indian entities to secure the solar power contracts. This does not specify the method of the bribery or the individual’s involvement.

Rohatgi states: 

“Count One and Count Five are more important than the others, but neither includes charges against Adani or his nephew. Count One pertains to certain other persons, excluding the two Adanis.”

Gautam Adani and Sagar Adani are not included in Count One, which claims a conspiracy to violate the FCPA, according to Rohatgi. He added that neither the Adanis nor any of their representatives are included in Count Five, which deals with obstruction of justice.

There is a huge lack of specificity in the chargesheet

Rohatgi pointed out that the chargesheet is missing important information, including identifying the people who were allegedly bribed or the techniques employed. He also said

“You must specifically state that so-and-so committed such acts and bribed certain individuals. This chargesheet alleges that the Adanis bribed Indian entities in connection with power purchases, but it does not contain a single name or detail about who was bribed or how,” 

He also questioned the practicality and responded with such a mysterious allegation

 “I don’t know how one can respond to this kind of chargesheet.”

Adani Group also denies the bribery allegations

Adani Green Energy Ltd (AGEL) stated in a regulatory filing that Gautam Adani, senior executive Vneet Jaain along with Sagar Adani. All of them had been cleared of all the bribery allegations by the US Department of Justice. 

AGEL refuted the media reports claiming Gautam Adani, Sagar Adani, and Vneet Jaain were implicated under the FCPA. Then these allegations as “incorrect.”
